Credit-based payment system

3. Account Registration

3.1 Account Requirements

You must be at least 16 years old to use the Service

5. Payment and Credits

5.1 Credit System

The Service operates on a credit-based payment system
Each valid form submission consumes one credit
Credits are purchased in advance
Credits do not expire unless your account is deleted

5.2 Payment Terms

All payments are processed through Stripe
Payments are due at the time of purchase
All prices are in EUR (Euro) unless otherwise stated
Refunds are handled in accordance with our refund policy

5.3 Refunds

Unused credits may be eligible for refund within 30 days of purchase, subject to our refund policy. Contact support@staticform.app for refund requests.

6. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

6.1 Your Responsibilities

You must obtain proper consent before collecting personal data through your forms
You must comply with all applicable data protection laws, including GDPR
You must provide appropriate privacy notices to form submitters
You are responsible for the security and handling of data collected through your forms

7. Intellectual Property

7.1 Service Ownership

The Service and its original content, features, and functionality are owned by StaticForm and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of all content submitted through your forms. By using the Service, you grant StaticForm a limited license to store, process, and transmit your content solely for the purpose of providing the Service.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances.

8.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Data Retention and Deletion

9.1 Account Deletion

You may delete your account at any time through your account settings
Account deletion permanently removes all your data, including forms, submissions, and files
Deleted data cannot be recovered

9.2 Inactive Accounts

Accounts that have been inactive for 2 years may be automatically deleted in accordance with our data retention policy. We will send email notifications before deletion.

9.3 Payment Records

Payment records are retained for 7 years as required by government regulations, even after account deletion. This is handled by our payment processor (Stripe).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATICFORM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless StaticForm, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Content submitted through your forms

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting it through your account settings or by contacting us at support@staticform.app.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All data associated with your account will be deleted in accordance with our data retention policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good faith negotiations, and if necessary, through appropriate legal channels.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StaticForm regarding the Service and supersede all prior agreements and understandings.
